Terms of Service

Effective date: May 7, 2026

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”) and Listahanan.ph, operated by ELEVENTECH OPC(“Listahanan,” “we,” “us,” or “our”) governing your use of the Platform. If you do not agree, you must immediately cease use of the Platform.

1. Definitions

  • Platform — the website, web applications, mobile interfaces, databases, and all related services operated under Listahanan.ph.
  • User — any natural or juridical person who accesses, browses, registers for, or uses the Platform in any manner.
  • Listing — any advertisement, posting, or information relating to real estate properties made available on the Platform, including descriptions, images, pricing, and contact details.
  • Third Party — any real estate broker, salesperson, property owner, developer, lessor, or any representative or agent thereof who submits Listings or receives inquiries through the Platform.
  • Content — all text, data, images, videos, messages, documents, or other materials uploaded, transmitted, or displayed on the Platform.
  • Services — all functionalities and features provided through the Platform, including property search, listing display, and inquiry facilitation.

2. Acceptance of Terms and Electronic Consent

By accessing or using the Platform, including by clicking “Create Account,” “Submit Inquiry,” or any similar mechanism indicating assent, you expressly:

  • acknowledge that you have read and understood these Terms;
  • agree to be bound by these Terms and all incorporated policies;
  • consent to the use of electronic records and communications.

Electronic acceptance shall have the same legal effect as a handwritten signature under applicable Philippine law.

3. Nature and Limitation of Services

The Platform is an intermediary technology service that enables Users to view and search Listings and submit inquiries to Third Parties.

Listahanan is not, and shall not be deemed to be:

  • a real estate broker, salesperson, or agent under Republic Act No. 9646 (Real Estate Service Act);
  • a party to any transaction between Users and Third Parties;
  • a fiduciary, escrow agent, or financial intermediary.

Nothing on the Platform shall be construed as rendering real estate service as defined under RA 9646. Listahanan does not negotiate, arrange, or facilitate transactions; does not guarantee ownership, title validity, or legal status of any property; and does not participate in pricing, terms, or execution of any transaction.

Listahanan may conduct limited, non-exhaustive identity and license verification procedures on Users. Such verification is procedural and does not constitute a legal guarantee or certification.

4. Acknowledgment, Assumption of Risk, and No Reliance

You expressly acknowledge that:

  • all Listings originate from Third Parties;
  • Listings may contain inaccuracies, omissions, duplications, outdated information, or fraudulent content;
  • Third Parties may misrepresent identity, authority, or property details.

You expressly assume all risks arising from reliance on Listings, communications with Third Parties, and entering into any agreement or transaction. You further acknowledge that:

  • you are not relying on the Platform for verification or guarantees;
  • any verification badges or indicators are limited and non-conclusive;
  • Listahanan does not warrant accuracy, legality, or authenticity.

Independent due diligence is your sole responsibility, including verification of identity of Third Parties, ownership or authority over property, regulatory compliance, and property condition and legal status.

Under prevailing jurisprudence, Users are bound to exercise due diligence and cannot rely solely on platform representations.

5. User Eligibility and Representations

You represent and warrant that:

  • you are at least eighteen (18) years old;
  • you have full legal capacity;
  • all information provided is accurate and not misleading.

You agree to use the Platform only for lawful purposes. Licensed real estate professionals must comply with Republic Act No. 9646 (Real Estate Service Act) and its implementing rules.

6. User Accounts and Security

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • all activities conducted under your account;
  • immediately notifying Listahanan of any unauthorized use.

Listahanan shall not be liable for losses arising from unauthorized access due to user negligence.

7. Listings and Content

All Listings are created and controlled by Third Parties. Listings may include, without limitation, inaccurate pricing, unauthorized postings, duplicate listings, misleading descriptions, or fraudulent representations. Listahanan does not independently verify the accuracy, authenticity, or completeness of Listing content.

By submitting Content, you grant Listahanan a perpetual, non-exclusive, worldwide, royalty-free license to use, reproduce, and display such Content in connection with the operation and promotion of the Platform. You retain ownership of submitted content.

Listahanan reserves the right, but not the obligation, to monitor, review, remove, or restrict Content at its sole discretion.

Listings are subject to freshness, quality, and conduct standards as set out in the Trust, Safety & Verification Policy, which is incorporated herein by reference.

8. Third-Party Interactions and Links

All communications and transactions occur solely between Users and Third Parties. Listahanan shall not be liable for fraud, misrepresentation, or illegal conduct by Third Parties; transaction failure or disputes; or financial losses arising from Third-Party interactions.

The Platform may contain links to third-party websites. Listahanan does not control or endorse such sites and shall not be liable for their content or practices.

9. Data Disclosure

By submitting an inquiry, you consent to disclosure of your personal data to the relevant Third Party. You acknowledge that:

  • Third Parties act as independent Personal Information Controllers;
  • Listahanan does not control subsequent data use by Third Parties;
  • Listahanan shall not be liable for misuse of such data by Third Parties.

Collection and processing of personal data by Listahanan is governed by our Privacy Policy.

10. Prohibited Use and System Integrity

Users shall not:

  • engage in fraudulent or deceptive conduct;
  • impersonate any individual or entity;
  • post false, fraudulent, or misleading listings;
  • upload falsified or forged documents;
  • use bots, scraping tools, or automated systems without authorization;
  • reverse engineer, decompile, or attempt to extract source code;
  • interfere with Platform operations or introduce malicious code.

Violation may result in immediate suspension without prejudice to legal action.

11. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.” Listahanan disclaims all warranties, including:

  • accuracy or completeness of Listings;
  • uninterrupted or error-free operation;
  • fitness for a particular purpose;
  • security or reliability.

Nothing herein excludes liability where such exclusion is prohibited by law.

12. Limitation of Liability

To the fullest extent permitted by law, Listahanan shall not be liable for:

  • direct, indirect, incidental, consequential, or punitive damages;
  • loss of profits, data, or opportunities;
  • fraud or misconduct by Users or Third Parties;
  • reliance on Listings or communications.

In all cases, total liability shall not exceed the total fees paid by the User, if any, within the preceding twelve (12) months.

Nothing herein excludes liability where such exclusion is prohibited by law.

13. Indemnity

You agree to defend, indemnify, and hold harmless Listahanan, its officers, and affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from:

  • your use of the Platform;
  • your Content or Listings;
  • your violation of these Terms;
  • your violation of any law or third-party rights.

14. Termination and Effects

Listahanan may suspend or terminate access at its sole discretion for violations of these Terms, suspected fraud, or legal or regulatory concerns. Such action shall not give rise to liability.

Upon termination, access to the Platform may be revoked and Content may be removed. Listahanan may also modify, suspend, or discontinue Services at any time without liability. Sections 4, 7, 8, 9, 11, 12, 13, 15, and 17 shall survive termination.

15. Governing Law and Venue

These Terms are governed by the laws of the Republic of the Philippines.

Any dispute shall be exclusively brought before the proper courts of Quezon City. The parties agree to attempt good-faith resolution within thirty (30) days before commencing formal proceedings. Nothing herein limits statutory rights.

For consumer protection matters, Users may also file complaints with the Department of Trade and Industry (DTI) through its consumer complaints channel at dti.gov.ph, pursuant to Republic Act No. 11967 (Internet Transactions Act of 2023) and Republic Act No. 7394 (Consumer Act of the Philippines).

16. General Provisions

Force Majeure. Listahanan shall not be liable for delays or failures due to causes beyond reasonable control.

Assignment. Listahanan may assign its rights and obligations without restriction. Users may not assign without prior written consent.

Notices. Notices may be given via email or Platform postings and shall be deemed received upon transmission or publication.

Entire Agreement. These Terms, together with the Privacy Policy and Trust, Safety & Verification Policy, constitute the entire agreement between the parties and supersede all prior agreements.

Severability. If any provision is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. Failure to enforce any provision shall not constitute a waiver of that right.

Amendments. Listahanan reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

By continuing to use Listahanan.ph, you acknowledge that you have read, understood, and agree to be bound by these Terms.
