Our Role and Principles

This Trust, Safety & Verification Policy establishes the rules, standards, and enforcement mechanisms governing platform safety, verification of Users and Listings, and detection and resolution of violations. It forms an integral part of the Terms of Service and is implemented in alignment with Republic Act No. 10173 (Data Privacy Act of 2012) and Republic Act No. 9646 (Real Estate Service Act).

Listahanan.ph, operated by ELEVENTECH OPC, operates as a neutral, intermediary technology platform. Listahanan is not a real estate broker, salesperson, or agent; is not a party to any transaction; and does not guarantee the identity, authority, or legitimacy of any party.

The Platform operates under the following principles:

  • User Responsibility First — Users bear primary responsibility for due diligence in all transactions.
  • Risk Disclosure — Real estate transactions involve inherent risks that cannot be eliminated by platform mechanisms.
  • Limited Intervention — Platform verification and enforcement actions are discretionary and not comprehensive.
  • Non-Reliance — Verification badges and indicators must not be treated as guarantees.

Verification Framework

Verification measures are implemented to reduce impersonation and fraud risk, improve transparency, and support (not replace) user due diligence.

A. Identity Verification

May include submission of government-issued identification, validation of contact details, and cross-checking identity consistency.

B. Professional Verification (Brokers and Agents)

May include submission of PRC license number, cross-referencing available regulatory data, and confirmation of declared affiliations. Verification is based solely on submitted information and accessible records and does not constitute accreditation or endorsement.

C. Property Authority Verification

For owner-listed properties, may include voluntary submission of proof of ownership or authority and document review for consistency. This review does not confirm ownership, title validity, or legal status of the property.

Verification Levels

  • Unverified — No verification conducted; all information self-declared.
  • Identity Verified — Identity elements reviewed; does not confirm licensing or property authority.
  • License Verified (Broker) — License information reviewed based on submitted data; does not guarantee current validity or compliance.
  • Owner Verified — Proof of ownership or authority reviewed for consistency; does not confirm title validity or legal status of the property.
  • Verification Badge — Indicates completion of one or more verification checks; does not constitute endorsement or guarantee.
Verification is based on information available at the time of review. It is not continuous or real-time and does not guarantee authenticity, legality, or future conduct. Listahanan does not guarantee document authenticity or the ongoing validity of any license.

Verification status may be downgraded or removed where fraud or misrepresentation is suspected, inconsistencies arise, complaints are substantiated, or required by law.

Fraud Prevention and Risk Management

Listahanan may implement preventive measures including:

  • duplicate listing detection;
  • anomaly detection in pricing or content;
  • behavioral monitoring for abnormal listing frequency, spam inquiries, or suspicious communication patterns;
  • account risk scoring (low / medium / high / suspected fraud).

Users acknowledge that fraud prevention systems are not foolproof; not all fraudulent activity can be detected or prevented; and Listahanan does not guarantee user safety.

User Responsibilities and Prohibited Conduct

Users are solely responsible for verifying identities and credentials, confirming property ownership or authority, validating licensing status, and conducting legal and financial due diligence. Users assume all risks associated with interactions and transactions.

Users shall not:

  • post false or misleading Listings;
  • impersonate brokers, agents, or owners;
  • use stolen or falsified documents;
  • misrepresent authority over property;
  • manipulate engagement systems;
  • circumvent verification processes.

Reporting a Listing

If you encounter a fake, inaccurate, or suspicious listing, you can report it directly from the listing page. We accept four report types:

  • Fake listing - property does not exist or is not actually for sale;
  • Already sold or rented - listing was not removed after closing;
  • Incorrect price - price significantly differs from what was advertised;
  • Incorrect details - photos, specs, or location do not match the actual property.

Reports are weighted by account standing. Verified accounts carry the highest weight, followed by registered users, then anonymous reports. When a listing's cumulative report weight crosses our threshold, it is automatically hidden and flagged for admin review.

Freshness enforcement: Active listings must be confirmed every 14 days. Listings not confirmed within 14 days are marked Stale. Listings inactive for 30 days are automatically removed from search results.

Reports should include a description of the issue, supporting evidence where available, and relevant links or identifiers. Submitting false or malicious reports may result in enforcement action against the reporting account.

Investigation and Enforcement

Upon receiving a report or flagging an account, Listahanan may conduct a preliminary assessment, review Listings and communications, analyze account behavior, and request additional information or documentation from the subject of investigation. Failure to cooperate may result in enforcement action.

Listahanan may, at its sole discretion, implement:

  • warning notices;
  • Listing removal;
  • verification downgrade;
  • account suspension;
  • permanent termination;
  • IP or device restrictions.

Listahanan may take action without prior notice in cases involving suspected fraud, risk to users, or legal or regulatory requirements. Listahanan may also remove Listings, suspend accounts, preserve data, and disclose information when required by law, regulatory authorities, or court orders.

Response Timelines (Non-Binding Targets)

  • Standard reports: acknowledgment within 48 hours; initial review within 3-5 business days.
  • High-risk cases: acknowledgment within 24 hours; temporary action within 24-72 hours.
  • Severe cases: immediate restriction possible; full investigation within 5-10 business days.

Appeals Process

Affected Users may submit an appeal regarding enforcement actions. Appeals must be submitted within a reasonable period, include supporting evidence, and clearly state the grounds for reconsideration.

Listahanan may uphold the decision, modify the enforcement action, or reinstate access. Decisions on appeal are final unless required otherwise by law.

Data Privacy in Trust Operations

Personal data may be processed for identity verification, fraud detection, investigation, and enforcement. Data may be disclosed to relevant Third Parties for inquiries and to lawful authorities where required.

Disclaimers and Liability

Listahanan does not guarantee:

  • detection or prevention of fraud;
  • accuracy of Listings;
  • identity or conduct of Users;
  • transaction outcomes.

To the fullest extent permitted by law, Listahanan shall not be liable for fraud committed by Users or Third Parties, financial losses, or disputes or damages arising from reliance on Listings or verification indicators. Third Parties are independent actors; Listahanan does not control their conduct and is not responsible for transactions or disputes between parties.

This Policy is governed by Philippine law. Sections relating to liability, disclaimers, and enforcement survive termination of any account or agreement. Listahanan may update this Policy at any time; continued use constitutes acceptance.

Due Diligence Tips

Under Philippine law and jurisprudence, buyers and parties to real estate transactions are expected to exercise due diligence. Verification badges support, but do not replace, independent verification.

  • Verify broker licenses using the PRC Online Verification System at online.prc.gov.ph;
  • Confirm property ownership and check for liens or encumbrances with the Register of Deeds;
  • Consider engaging a licensed broker, lawyer, or financial adviser before signing agreements;
  • Keep records of inquiries, offers, and agreements for your protection;
  • Review Verified Broker / Verified Owner badges but always conduct independent verification.
